TeraPulse 是 Jincoco（以下簡稱「我們」）獨立開發的第三方 App，與 Tesla, Inc. 沒有任何附屬、合作、背書或贊助關係。本 App 以「現狀」提供，使用前請詳閱以下條款。
一、接受條款
下載、安裝或使用 TeraPulse 即表示你已閱讀、理解並同意接受本使用條款及隱私權政策的全部內容。若你不同意任何條款，請勿使用本 App。
二、App 描述
TeraPulse 是一款獨立開發的第三方 App，透過藍牙（BLE）直接連線你的 Tesla 車輛，將時速、功率、電量等資訊呈現於你的 iPhone 上。本 App：
- 不附屬於 Tesla, Inc.，亦未獲其官方授權、背書或贊助
- 不透過 Tesla 雲端或任何第三方伺服器運作
- 不收集、不傳送任何使用者資料（詳見隱私權政策）
三、授權範圍
我們授予你個人、非商業、非排他、不可轉讓的使用權，僅供你個人於合法擁有或合法使用之 Tesla 車輛上使用本 App。你不得：
- 逆向工程、反組譯、解編、嘗試取得本 App 原始碼
- 修改、改作、衍生、散布或商業利用本 App
- 移除或變更 App 內的版權聲明、商標標示
- 將本 App 用於任何違法或損害他人權益之用途
四、無擔保聲明
本 App 以「現狀（AS IS）」及「現有可用（AS AVAILABLE）」狀態提供，我們不對下列事項做任何明示或暗示的擔保：
- App 的功能正確性、即時性、完整性、可用性
- BLE 連線的穩定度、延遲、訊號品質
- 所顯示之車輛資料（時速、功率、電量、續航等）的精準度
- 與特定 Tesla 車型、車輛軟體版本、iOS 版本之相容性
- App 不會中斷、無錯誤、不會受第三方因素（如 Tesla OTA 更新）影響而失效
五、責任限制
在法律允許的最大範圍內，我們對因使用或無法使用本 App 而導致的任何直接、間接、衍生、特殊或懲罰性損害不承擔責任，包括但不限於：
- 因依賴本 App 顯示之資訊（時速、電量、續航等）而導致的任何決策損失
- 車輛硬體、軟體、配件之損壞
- 人身傷害、財產損失、交通事故
- BLE 連線失敗、資料延遲或不準確造成的任何後果
- 因 iOS 系統更新、Tesla 軟體更新或其他第三方因素導致 App 失效造成的損失
你了解駕駛車輛存在固有風險，並同意自行承擔使用本 App 的全部風險。
六、使用者責任
你同意：
- 駕駛時優先注意前方道路，本 App 為輔助資訊用途，不得取代車輛原廠儀表
- 操作 App 前先停妥車輛，駕駛中不得手動操作
- 將手機妥善固定，避免於行進間滑落造成危險
- 遵守你所在地區的交通法規與駕駛規範
- 合法擁有或合法使用所連線之 Tesla 車輛
七、智慧財產權與商標
「TeraPulse」名稱、logo 及 App 程式碼之著作權屬 Jincoco 所有。
Tesla®、Model S、Model 3、Model X、Model Y 等名稱為 Tesla, Inc. 之註冊商標。本 App 為相容性目的善意使用上述商標，並無侵權意圖，亦不代表 Tesla, Inc. 之背書或合作關係。
八、條款修訂
我們保留隨時修改本條款之權利。重大變更會於 App 內或下次發行時告知，修訂後之條款於本頁面更新「最後更新」日期後即時生效。你於修訂後繼續使用本 App 即視為同意修訂後之條款。
九、終止
你可隨時刪除 App 終止本條款。我們亦保留於以下情況終止你使用權之權利：
- 你違反本條款任一規定
- 本 App 因任何原因（含商業考量、法律要求、技術因素）停止營運
十、準據法與管轄
本條款之解釋與適用以中華民國法律為準據法。因本條款所生爭議，雙方同意以臺灣臺北地方法院為第一審管轄法院。

TL;DR
TeraPulse is an independent third-party app developed by Jincoco ("we", "us"), not affiliated with, endorsed by, or sponsored by Tesla, Inc. The app is provided "as is". Please read these terms carefully before use.
1. Acceptance of Terms
By downloading, installing, or using TeraPulse, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the app.
2. Description of Service
TeraPulse is an independently developed third-party app that connects to your Tesla vehicle directly via Bluetooth (BLE) and displays speed, power, battery, and related metrics on your iPhone. The app:
- Is not affiliated with, endorsed by, or sponsored by Tesla, Inc.
- Does not communicate through Tesla's cloud or any third-party server
- Does not collect or transmit any user data (see Privacy Policy)
3. License Grant
We grant you a personal, non-commercial, non-exclusive, non-transferable license to use TeraPulse on Tesla vehicles you legally own or lawfully operate, for your own use only. You may not:
- Reverse engineer, decompile, disassemble, or attempt to derive source code from the app
- Modify, adapt, create derivative works of, distribute, or commercially exploit the app
- Remove or alter copyright notices or trademark designations within the app
- Use the app for any unlawful purpose or in a way that infringes the rights of others
4. Disclaimer of Warranties
The app is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding:
- Functional correctness, timeliness, completeness, or availability of the app
- Stability, latency, or signal quality of BLE connections
- Accuracy of displayed vehicle data (speed, power, battery, range, etc.)
- Compatibility with any specific Tesla vehicle model, vehicle firmware, or iOS version
- Uninterrupted or error-free operation, or that the app will not be impacted by third-party factors (e.g., Tesla OTA updates)
5. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use or inability to use the app, including but not limited to:
- Decisions made in reliance on data displayed by the app (speed, battery, range, etc.)
- Damage to your vehicle hardware, software, or accessories
- Personal injury, property damage, or traffic accidents
- Consequences arising from BLE connection failures, data delays, or inaccuracies
- App malfunction caused by iOS updates, Tesla software updates, or other third-party factors
You acknowledge that operating a vehicle involves inherent risks, and you agree to assume all risks of using the app at your own discretion.
6. User Responsibilities
You agree to:
- Keep your attention on the road while driving; the app is supplementary information and does not replace the vehicle's factory instrumentation
- Pull over safely before interacting with the app; do not operate the app while driving
- Mount your phone securely so it does not become a hazard during travel
- Comply with all applicable traffic laws and regulations in your jurisdiction
- Use the app only with Tesla vehicles you legally own or lawfully operate
7. Intellectual Property and Trademarks
The "TeraPulse" name, logo, and app source code are the copyrighted property of Jincoco.
Tesla®, Model S, Model 3, Model X, and Model Y are registered trademarks of Tesla, Inc. The app uses these trademarks in good faith for compatibility purposes only, with no infringement intent and without implying any endorsement or partnership with Tesla, Inc.
8. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be announced in-app or in the next release. The updated terms become effective upon updating the "Last updated" date on this page. Continued use after updates constitutes acceptance of the revised terms.
9. Termination
You may terminate these Terms at any time by uninstalling the app. We reserve the right to terminate your use under the following circumstances:
- You breach any provision of these Terms
- The app ceases operation for any reason (including business, legal, or technical considerations)
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of China (Taiwan). Any disputes arising hereunder shall be submitted to the Taipei District Court of Taiwan as the court of first instance.
